These Terms & Conditions apply when you use foreversweet.shop or place an order with Forever Sweet Bakery (“Forever Sweet Bakery,” “we,” “us,” or “our”). By using our website or placing an order, you agree to these terms.
Orders and Acceptance
An online order is accepted after payment is received and an order confirmation is issued. Acceptance remains subject to product and fulfillment availability and our receiving all details required to complete the order. We may refuse, cancel, or adjust an order if we cannot fulfill it, required information is missing, a product is unavailable, the request is inappropriate, or the website contains a pricing, availability, or product-setup error. If this occurs, we will contact you to resolve the order and provide any refund required by the resolution or by law.
You are responsible for providing complete and accurate contact, order, customization, and fulfillment information. We may contact you for clarification. Production or fulfillment may be delayed if you do not respond or if required details remain incomplete.
Product Availability and Lead Times
Lead times vary by product, level of customization, fulfillment method, and bakery schedule. Available dates shown during ordering are based on the lead time and capacity for the selected product. You are responsible for selecting an available date that meets that product’s lead time.
Availability may be limited during holidays, peak periods, and other high-demand times. An available date or product may change before an order is completed and confirmed.
Custom Orders and Personalization
Custom and personalized items are made from the information you provide, which may include flavors, quantities, names, messages, colors, themes, designs, images, and fulfillment details. Review all information carefully before placing your order.
Requests to change order details, design elements, or the fulfillment date must be made at least one week before the scheduled fulfillment date. A timely request is not automatically accepted. Changes are available only if our production work and schedule allow them.
Because bakery items are handmade, reasonable variations in color, size, shape, decoration, design placement, and finish may occur. Colors and product details may also look different on a screen than they do in person. Website photographs are examples and do not guarantee an exact duplicate.
Uploaded Images and Customer-Provided Content
If you upload or provide an image, logo, design, message, or other content, you confirm that:
- You own it or have permission to use it for your order.
- Its use does not violate another person’s copyright, trademark, privacy, publicity, or other rights.
- It is not unlawful, offensive, inappropriate, or privacy-violating.
- You give Forever Sweet Bakery limited permission to use it as needed to review, prepare, fulfill, and support your order.
We may refuse any uploaded content, message, or custom request that we reasonably believe is unlawful, offensive, inappropriate, privacy-violating, infringing, or otherwise unsuitable for our business.
Pickup Orders
Pickup windows vary based on availability. Your scheduled date and available pickup window will be provided as part of the order process or order communications. You are responsible for picking up the order during that window.
If you are late or do not arrive, we will hold the order if reasonably possible, based on the product, available storage, quality, and food-safety considerations. Handling is decided case by case. Missed pickup does not qualify for a refund or store credit, except as required by law. A perishable order may be disposed of when necessary for quality or food safety. We cannot guarantee product quality after the scheduled pickup time.
Local Delivery
Local delivery is available only for select products and areas. Delivery times are estimates, not guarantees, and may be affected by traffic, weather, access, routing, and bakery operations.
Orders cannot be left unattended. You must provide a complete and accurate address, working contact information, access instructions, and an available recipient. If delivery cannot be completed because of a wrong or incomplete address, lack of access, no available recipient, or another customer-caused issue, you may need to arrange pickup or pay for another delivery attempt. No refund or store credit is provided for a customer-caused delivery failure, except as required by law.
Shipping
Shipping is available only for select products. Estimated ship and delivery dates are not guaranteed. Carrier schedules, weather, and other conditions outside our control may cause delays.
You are responsible for entering a complete and accurate shipping address. We will try to help with an address problem if you contact us promptly, but rerouting, replacement, or recovery may not be possible after a package is processed or shipped. Costs or losses caused by a customer-provided wrong address are the customer’s responsibility, except as required by law.
PO boxes may be used when the selected product and carrier permit delivery to them. Some products or shipping services may require a street address.
Warm weather can affect chocolate, icing, decorations, and other temperature-sensitive products. Even with careful packaging, melting, softening, shifting, or other quality changes may occur during transit. By ordering a temperature-sensitive product for shipping, you accept the ordinary risks associated with the destination weather and transit conditions.
Carrier delays, delivery failures, loss, and transit damage are reviewed case by case. We may request photographs of the product, packaging, and shipping label and may assist with a carrier claim. To the fullest extent permitted by law, Forever Sweet Bakery is not responsible for carrier delays or damage that occurs after a package leaves our care. Nothing in this section limits any right or remedy that cannot lawfully be limited.
Changes, Cancellations, Refunds, and Store Credit
Cancellation availability and deadlines vary by product and by whether purchasing, preparation, or production has started. Contact us as soon as possible if you need to cancel. A cancellation is not effective unless Forever Sweet Bakery confirms that it has been accepted.
Custom, made-to-order, and perishable orders are not refundable once production begins. Before production begins, we will review a cancellation under the requirements for that product and the work already completed. If we choose to make an exception, store credit may be offered only at Forever Sweet Bakery’s discretion.
Customer mistakes, missed pickup, wrong or incomplete addresses, customer-caused delivery failures, and cancellations made too late for the product or production stage do not qualify for a refund or store credit, except as required by law.
If Forever Sweet Bakery makes an error, we will review the issue and may provide a replacement, refund, partial refund, or store credit depending on the nature and extent of the problem. Report an issue within 24 hours when possible and no later than 48 hours after pickup or delivery. Include clear photographs of the product, packaging, and label when applicable. Waiting beyond this period may prevent us from confirming the issue or offering a remedy, except as required by law.
An approved refund will be returned to the original payment method when possible. If that is not possible, store credit will be provided. Refund timing may depend on the payment provider.
Allergens and Dietary Requests
We take food allergies seriously. Forever Sweet Bakery is not a nut-free bakery. Our products are made in a shared kitchen that handles wheat, dairy, eggs, soy, peanuts, and tree nuts. Ingredients, equipment, tools, work areas, storage, and air space may be shared.
We cannot guarantee that any item is allergen-free or cross-contact-free. A product described with a dietary label, such as gluten-free, dairy-free, vegan, or nut-free, does not eliminate shared-kitchen or cross-contact risk. Customers with allergies or dietary restrictions should contact us before ordering, consider the shared-kitchen information, and decide whether a product is appropriate for their needs and for anyone expected to consume it.
Pricing and Payment
Prices are listed in U.S. dollars and may change without notice. The price shown at checkout when you place the order applies unless there is an obvious pricing or product-setup error. If an error occurs, we may contact you to approve a correction or cancel the affected order and provide the appropriate refund.
Payment is required at checkout for online orders unless Forever Sweet Bakery has separately approved another arrangement. Online payments are processed through Square.
Website Content and Intellectual Property
The text, bakery photographs, product images, logos, graphics, designs, and other content on our website belong to Forever Sweet Bakery or their respective licensors and are protected by applicable intellectual-property laws. You may not copy, reproduce, publish, distribute, sell, or commercially use that content without permission from the applicable owner.
Acceptable Website Use
You may not misuse our website, interfere with its operation or security, attempt unauthorized access, submit false or fraudulent information, or use the website in violation of law or another person’s rights.
Limitation of Liability
To the fullest extent permitted by law, Forever Sweet Bakery is not liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or our products or services.
Nothing in these terms excludes or limits liability, rights, or remedies that cannot lawfully be excluded or limited.
Governing Law
These Terms & Conditions are governed by the laws of the State of Connecticut, without limiting any consumer protection that applies under law.
Changes to These Terms
We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated Last Updated date. The terms in effect when an order is placed apply to that order unless a change is required by law or agreed to by both you and Forever Sweet Bakery.
